1. Acceptance of Terms

By accessing and using Demogen ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Demogen is an AI-powered platform that automatically generates demo videos from landing page URLs. The Service includes:

• Automatic script generation from website content
• AI voiceover creation
• Animated video production in multiple formats (horizontal, square, vertical)
• Video download capabilities

3. User Accounts and Credits

3.1 Account Registration: You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Free Credits: New users receive 1 free video credit upon registration. Free videos include a "made with demogen.video" watermark and are limited to horizontal format only.

3.3 Purchased Credits: Additional credits can be purchased for $15 per video. Purchased credits unlock all formats and remove watermarks. Credits never expire.

4. Payment Terms

4.1 Pricing: Prices are displayed in USD and are subject to change. Current pricing is $15 per video credit during early access.

4.2 Payment Processing: Payments are processed securely through payment gateway. We do not store your payment information.

4.3 No Subscriptions: DemoGen operates on a pay-per-video model with no recurring charges or subscriptions.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Generate videos from websites you do not own or have permission to use
• Upload or process content that infringes intellectual property rights
• Create videos containing offensive, defamatory, or harmful content
• Attempt to reverse engineer or abuse the Service
• Use the Service to generate spam or misleading content

6. Content Ownership and License

6.1 Your Content: You retain all rights to the websites and content you submit to the Service.

6.2 Generated Videos: For paid videos (without watermark), you own the generated video and may use it for commercial purposes. Free videos with watermarks may be used with attribution to Demogen.

6.3 Service License: You grant Demogen a license to process your submitted content solely for the purpose of generating your video.

7. Service Availability

We strive to maintain 99% uptime but do not guarantee uninterrupted service. We reserve the right to:

• Perform scheduled maintenance
• Modify or discontinue features with notice
• Refuse service to anyone for any reason

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the Service in the past 12 months
• We are not responsible for the content or quality of websites you submit

10. Privacy and Data

We collect and use your data as described in our Privacy Policy. We use industry-standard security measures to protect your information but cannot guarantee absolute security.

11. Termination

11.1 By You: You may terminate your account at any time. Unused credits are subject to our refund policy.

11.2 By Us: We may suspend or terminate accounts that violate these terms or for any reason with notice.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective upon posting. Continued use of the Service constitutes acceptance of modified terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
